USE: The Software License Agreement allows a marketing company to distribute the
software and documentation of a software product that belongs to another party.
This relationship is on a non-exclusive basis. The software provider also allows
the marketing company to use the products in-house. The marketing company
assumes responsibility for maintenance and support. The benefit of this Software
License Agreement is that the software developer can create multiple
relationships with multiple marketing companies and still retain the rights to
the software. The agreement also doesn't require that the marketing company
achieve a certain dollar level of sales or a minimum royalty payment. This
Software License Agreement allows for the software company to obtain the largest
market penetration as possible. Because the agreement is not exclusive, the
marketing company could find other competitors for the same product.
